All officers, employees, and agents of ProResults shall preserve the integrity and the confidentiality of individually identifiable health information (IIHI) pertaining to each client or specimen donor. This IIHI is protected health information (PHI) and shall be safeguarded to the highest degree possible in compliance with the requirements of the security rules and standards established under the Health Insurance Portability and Accountability Act of 1996 (HIPAA).
ProResults and its officers, employees, and agents will not use or disclose an individual's protected health information for any purpose without the properly documented consent or authorization of the client or his/her authorized representative unless required to do so by federal and/or state law or regulation; unless an emergency exists; or, unless the information has been sufficiently de-identified so that the recipient would be unable to link the information to the client.
ProResults shall implement reasonable administrative, technical, and physical safeguards to protect PHI from any intentional or unintentional use, or disclosure that is a violation of HIPAA regulations.
ProResults shall make all reasonable efforts to lessen the harm caused by an improper use of disclosure of protected health information by its workforce or by any business associate.
ProResults strongly urges all employers to use the Drug Screen Release Form provided by ProResults, for each employee that is drug screened.
Drug Screen Release Form states:I (employee/specimen donor) CERTIFY THAT THE INFORMATION ABOVE IS VALID AND ACCURATE TO THE BEST OF MY KNOWLEDGE, AND I UNDERSTAND THAT THIS INFORMATION WILL ONLY BE USED FOR IDENTIFICATION AND VALIDATION AS IT RELATES TO THE REQUESTED TASK. I HEREBY CONSENT TO HAVE MY SPECIMEN TAKEN BY PRORESULTS, AND I UNDERSTAND THAT IT WILL BE USED FOR DRUG ANALYSIS BY PRORESULTS, WITH THE RESULTS OF MY SPECIMEN BEING MADE AVAILABLE TO THE BELOW NAMED COMPANY/EMPLOYER OR THEIR DESIGNEE. I HEREBY RELEASE PRORESULTS AND THEIR EMPLOYEES, AGENTS AND REPRESENTATIVES FROM ANY AND ALL LIABILITY ARISING FROM THE RELEASE OF THE INFORMATION DISCOVERED FROM MY TEST.

ProResults staff verifies all specimen donors' identification, as a standard collection procedure (personal-use tests do not require this, however it will be noted that ID was NOT presented at the time of collection). All samples are carefully labeled at the collection site and contain a tamper-evident seal that is placed over the specimen container. Additionally, the specimen container is placed in a tamper-evident bag, along with any chain of custody forms. Upon arrival at the laboratory every sample is examined to ensure that the tamper evident seals are still intact and that the identification numbers on the sample and the chain of custody match.
